In Minnesota, auto owners must have Underinsured/Uninsured Motorist (UIM/UM) coverage. The minimum coverage required is $25,000 per person and $50,000 per accident for both Underinsured and Uninsured coverage.
This is coverage you have under your own insurance intended for use when a collision occurs, and the person responsible for the collision failed to have insurance or failed to have enough insurance to cover the cost of your injuries as a result of the collision.
Despite the Underinsured/Uninsured coverage coming from your auto insurance, this coverage is not the first one to apply at the time of the collision. Rather, this coverage is meant to bridge the gap left by Underinsured/Uninsured Motorists after your No-Fault insurance is exhausted.
First, if you are injured in an accident, it’s best to seek treatment to assess your overall injuries. Next, contact your insurance company and report the collision with the uninsured driver. By reporting the collision, you have started the process of your claim. You should then continue to use the No-Fault benefits you have in place and seek treatment. Once the No-Fault benefits are exhausted, then the Uninsured Motorist Claim will come into play. Since underinsured motorist coverage is additional coverage, it will not apply until the limits of both the No-Fault Insurance and the Bodily Injury Insurance are exhausted. The Minnesota minimum standard for No-Fault (NF) benefits is $20,000 in medical expenses, and the minimum Minnesota standard for Bodily Injury (BI) coverage is $30,000 per person, meaning that to have an underinsured motorist claim with an absolute minimum in NF and BI coverage, you would have to exhaust the $50,000 in medical expenses already in place. Any remaining costs, such as additional medical expenses, out-of-pocket expenses, wage loss, and pain and suffering, will be compiled for the Underinsured Motorist Claim.
