You just attended an IME, which your Auto Insurance had requested and scheduled, to review your treatment history and get a second opinion on your overall injuries as a result of an accident you were involved in.
You did everything right: you prepared, sought advice from your attorney, arrived on time or early, and were polite, cooperative, and honest with the IME physician. You answered their questions directly without oversharing, and you remained consistent in your answers and in your overall pain and symptoms. Now you are left to wonder: what’s next? The first thing you should do is contact your attorney at BK Law Group and let them know how you felt the IME went overall. What you felt comfortable with and situations or questions you felt weren’t related to the accident. It’s beneficial to speak with your attorney about the IME, as they have much more experience with IMEs and the subsequent reports. It might be helpful to take notes about the IME overall and how you felt during the exam.
After discussing the IME with your attorney, the next thing your attorney will do is reach out to the IME contact and your Auto Insurance to request a copy of the IME report. You are also entitled to a copy of this report. Either your attorney will send you a copy, or, if you have not retained an attorney, you should reach out to your Auto Insurance and request a copy of this report.
Once you receive this report, compare and contrast the physician’s IME report to the notes you took immediately after the IME and while you were debriefing with your attorney. This step is important as it will help you identify any areas of the IME report that you feel were inaccurate.
Once the IME report comes back, it will indicate whether your No-Fault benefits have been cut off or remain available after the IME.
If you are Cut Off, there will be a date listed in the report that notes when your IME benefits have been terminated. This date can sometimes be before the IME even occurred. This is usually due to the IME physician stating that your treatments from that day forward were considered excessive and thus the reason for your benefits being terminated.
You can still treat your injuries even if your auto insurance cuts you off. The payments would then be made by your Health Insurance, and they would hold a Subrogation Lien for the value of the bills to be reimbursed once the claim has been settled.
This is unfortunately uncommon as the IME physician is paid by your Auto Insurance to conduct the IME and paid for the subsequent report. However, if you review the IME report and it never states that your No-Fault benefits are cut off, you are one of the few with a favorable IME report. It’s important that your attorney and legal team at BK Law Group are aware of the favorable IME report, as that will be beneficial to your overall claim.
Even with a favorable IME report, they can still cut off benefits. This occurs when the IME physician notes that treatment is necessary but limits the treatment timeline to what they deem reasonable. This often does not align with what your treating physician believes would be true for your overall recovery. It’s important to note these dates, as once you are cut off, your health insurance will then pay for any treatments made after the cutoff date, and they will establish a subrogation lien for future reimbursement.
It’s important to know that you can still treat your injuries and should treat your pain, despite the IME results or a cut-off date.
